Terms and Conditions

The following terms and conditions ("Terms and Conditions") set forth the contractual agreement between Loylty Rewardz Mngt Pvt Limited ("Loylty Rewardz") and the Member (as defined herein) for the WorldMiles Program (as defined herein). These Terms and Conditions shall be read in conjunction with such other terms and conditions as may be imposed by IndusInd Bank Ltd., India ("IndusInd Bank") including the Cardholder Agreement and Ezeego One Travels and Tours Private Limited ("Ezeego1") and any other Program Partners ("Program Partners").

Members are advised to read, understand and accept these Terms and Conditions prior to using the website www.myWorldMiles.com or IndusInd Bank WorldMiles Credit Card. In these Terms and Conditions, unless the context otherwise requires, the following terms shall have the same meaning as set out hereinafter:

  1. "Applicant" refers to any individual who fills in the IndusInd Bank WorldMiles Credit Card application form to enroll into the WorldMiles Program.
  2. "Data" means information personal to a Member, including without limitation, name, address, telephone number, date of birth, employer, transaction details , contact details with IndusInd Bank, or any other information received from IndusInd Bank as a result of availing of the IndusInd Bank WorldMiles Credit Card
  3. "IndusInd Bank WorldMiles Credit Card" means the credit card issued by IndusInd Bank to a Member through which he /she is automatically enrolled into the WorldMiles Program.
  4. "FlightMiles" means the miles accumulated by a Member into the WorldMiles Membership account on purchase of an airline ticket on a Qualifying Flight at www.myworldmiles.com using the IndusInd Bank WorldMiles Credit Card. These miles are credited to the Members WorldMiles Membership account after the sector has been flown.
  5. "Fraud" means fraud, dishonesty, and deceit, and includes, without limitation, knowingly supplying incorrect information at any time to accrue WorldMiles, attempting to accrue WorldMiles for sectors that have not been flown or are not eligible for WorldMiles, altering any documents to procure WorldMiles, attempting to accrue WorldMiles for sectors flown by any person other than the Member, using or attempting to use stolen or counterfeit tickets on www.myworldmiles.com, attempting to accrue WorldMiles more than once for the same sector, selling, bartering and/or purchasing WorldMiles including attempting to sell or transfer WorldMiles by means of Internet based sales or auctions, knowingly benefiting from the Fraud or misconduct of another Member or individual.
  6. "Member" means a IndusInd Bank WorldMiles Credit Card holder who gets enrolled in the WorldMiles Program.
  7. "Membership" means being member of the WorldMiles Program. Membership is subject to approval of the IndusInd Bank WorldMiles credit card application.
  8. "PartnerMiles" means the miles accumulated by a Member into the WorldMiles Membership account for making hotel / car-rental / other travel bookings excluding airline ticket bookings at www.myworldmiles.com or at eligible WorldMiles Partner Outlets/ online stores using his IndusInd Bank WorldMiles Credit Card
  9. "Processing" means obtaining, using, examining and verifying or recording Data in any electronic or any paper form.
  10. "Processed" means the completion of Processing.
  11. "Qualifying Flight" or "Valid Flight" means a flight booked on www.myworldmiles.com by the Member upon the purchase of a paid ticket against the fare that is eligible for earning FlightMiles.
  12. "Sector" means a single non-stop direct eligible flight between two destinations, such as Delhi- Mumbai.
  13. "SpendMiles" means the miles accumulated by a Member into the WorldMiles Membership account for using the IndusInd Bank Credit Card for any retail purchase other than cash withdrawal, EMI, Fees etc. and appearing on a statement issued by IndusInd Bank.
  14. "Welcome Gift" means the flight ticket given by Loylty Rewardz on enrolling to the WorldMiles Program. Member is eligible to claim the welcome gift subject to payment of joining fees as per the applicable fee plan and first retail transaction on the IndusInd Bank WorldMiles Credit Card. The welcome gift given to the Member is subject to change and Loylty Rewardz reserves the right to do so.
  15. "WorldMiles" means the miles accumulated by the Member in his WorldMiles Membership Account. WorldMiles are total sum of FlightMiles, SpendMiles and PartnerMiles in Members WorldMiles account.
  16. "WorldMiles Flight ticket" means a free ticket issued by Loylty Rewardz to a Member against redemption by the Member of appropriate part of the Members WorldMiles from the Members WorldMiles Membership account.
  17. "WorldMiles Group Membership Account" means the account maintained by Loylty Rewardz into which the WorldMiles of more than one Member may accrue on specific instructions by such Members. The WorldMiles Membership Account shall remain that of the Member requesting for the WorldMiles to be clubbed into this account.
  18. "WorldMiles Membership Account" means the Members account maintained with Loylty Rewardz in which the WorldMiles accumulate.
  19. "WorldMiles Program" means the loyalty program by Loylty Rewardz offering benefits, facilities or arrangements to a Member on account of their Membership with WorldMiles.

USE OF SITE

  1. Loylty Rewardz grants the Member a limited, non-transferable license to use this site in accordance with the terms and conditions mentioned herein.
  2. The Member may only use this site to make legitimate reservations or purchases and shall not use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand. The Member shall not make reservation in the name of a fictitious person.
  3. The Member hereby agrees that they shall not use any device, software or routine that would interfere or be reasonably expected to interfere with the normal working of this site. Members shall not post or transmit any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage acts or omissions that would amount to a criminal offence or attempt to commit a criminal offence, or give rise to civil liability, or otherwise viliate any law.
    1. In addition, Members are prohibited from posting or transmitting any information which
    2. infringes the rights of others or viliates privacy or publicity rights,
    3. is protected by patent, copyright, trademark or other proprietary right, unless with the express written permission of the owner of such right,
    4. contains a virus, bug, worm or other harmful item(s) or program(s), or
    5. is used to unlawfully collude against another person in restraint of trade or competition. Members shall be solely liable for any damages resulting from any infringement of copyright, trademark, or other proprietary right, or any other harm resulting from your use of this site.

CONFIDENTIALITY

Information concerning Loylty Rewardz or any of their subsidiaries, their employees, customers, agents, suppliers, franchisees, affiliates or others on whom data is clilected, stored, or processed is the property of Loylty Rewardz and is confidential except for the necessary disclosures required by law.

COPYRIGHT POLICY

Loylty Rewardz hlids the copyright in respect of this site, and the content provided in this site, including the text, graphics, button icons, audio and video clips, digital downloads, data compilations and software, may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed without the written permission of Loylty Rewardz, and/or their third party providers and distributors, except that the Members may download, display and print the materials presented on this site for their personal, non-commercial use only. The Member may not use any "robot," "spider" or other automatic device, or a program, algorithm or methodliogy having similar processes or functionality, or any manual process, to monitor or copy any of the Web pages, data or content found on this site, in any case without the prior written permission of Loylty Rewardz. The Member agrees that they will not transmit or otherwise transfer any web pages, data or content found on this site to any other computer, server, website, or other medium for mass distribution or for use in any commercial enterprise. Unauthorized use of this site and/or the materials contained on this site may viliate applicable copyright, trademark or other intellectual property laws or other laws. Member must retain all copyright and trademark notices, including any other proprietary notices, contained in the materials, and the Member must not alter, obscure or obliterate any of such notices. The use of such materials on any other website or in any environment of networked computers is prohibited.

ACCURACY OF INFORMATION

Loylty Rewardz does not warrant or guarantee the accuracy or completeness of the information provided on this site. Under no circumstances will Loylty Rewardz be liable for any loss or direct, indirect, incidental, special or consequential damages caused by reliance on this information. The information on this site may be changed or updated without notice. Loylty Rewardz may also make improvements and/or changes in the products, services and/or programs described on this site at any time without prior notice.

ENFORCIBILITY OF THESE PROVISIONS

Should any of these terms and conditions be held invalid, that invalid provision shall be construed to be consistent with the applicable law, and in manner so as to remain consistent with the original intent of Loylty Rewardz. Provisions not otherwise held invalid shall remain in force.

SECURITY WARNINGS

The Member shall take precautions to ensure that whatever they select for use is free of such items as viruses, worms, trojan horses, malicious codes and other items of a destructive nature. IN NO EVENT WILL Loylty Rewardz BE LIABLE TO ANY MEMBER FOR ANY LOSS OR DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES CAUSED BY USE OF THIS WEBSITE, OR ANY OTHER HYPERLINKED OR INTERFACED WEBSITE OR DUE TO ACCESSING DATA RESIDING ON THIRD PARTY SERVERS NOT BELONGING TO Loylty Rewardz.

Loylty Rewardz specifically disclaims all warranties with respect to this site or your use thereof, express, implied, or otherwise, including without limitation, all warranties of merchantability and fitness for a particular purpose. Loylty Rewardz shall not be liable for any damages resulting from the use or misuse of this site or the information on this site.

MEMBERSHIP

  1. Membership to the WorldMiles Program is open only to individuals who are above 23 years of age at the time of enrliment into the WorldMiles Program. Members herein represent that they are of the said age and are capable, ready and willing to discharge any liability that the Members may incur as a result of the use of this site.
  2. Membership is not open to companies, partnerships, unincorporated associations or other such entities
  3. Membership to the WorldMiles Program is offered at the sole discretion of Loylty Rewardz and WorldMiles may refuse Membership to any person without assigning any reasons.
  4. The WorldMiles Membership number will be mentioned as the fourth line embossing on the IndusInd Bank WorldMiles Credit Card. The Member becomes entitled to use the Membership number specified on the IndusInd Bank WorldMiles Credit Card as soon as the Member gets the IndusInd Bank WorldMiles Credit Card.
  5. IndusInd Bank WorldMiles Credit Card is valid for use only during the period indicated on it. IndusInd Bank WorldMiles Credit Card and WorldMiles Membership number may be used only by the Member.
  6. In the event of loss of IndusInd Bank WorldMiles Credit Card, a duplicate card shall be issued to the Member. The Member needs to contact IndusInd Bank call centre directly for the same
  7. Fraud or misuse of IndusInd Bank WorldMiles Credit Card or WorldMiles Program benefits may result in termination of Membership or withdrawal of benefits at the discretion of Loylty Rewardz
  8. In case of Fraud or misuse of WorldMiles Membership account, the Member concerned would be personally liable for any and all costs, taxes, charges, claims or liabilities of any nature, arising from the benefits, facilities or arrangements provided or made available to a Member by Loylty Rewardz pursuant to the Membership of the WorldMiles program.
  9. Two Members who belong to the same family may request Loylty Rewardz to accrue all WorldMiles accrued in the individual WorldMiles Membership Account into one WorldMiles Group Membership Account. The WorldMiles Membership Account of the requesting Member shall become the WorldMiles Group Membership Account.

RESPONSIBILITIES

  1. Members are responsible for maintaining the confidentiality of their WorldMiles Membership account information and their password/s.
  2. Loylty Rewardz will endeavour to ensure that the services, benefits, facilities and arrangements as expressed or advertised under the Worldmiles Program are available to Members, however, Loylty Rewardz will not be liable for any loss or damage, whether direct or indirect arising from the provision or non provision, whether whlie or part, of any such services, benefits, facilities or arrangements.
  3. In addition to these Terms and Conditions, a Member shall be bound by such terms and conditions as may be imposed by any of the Worldmiles Program partners.
  4. All Bookings/Modifications/Cancellations/Pricing rules related to services provided at WorldMiles Program will be governed by the terms & conditions of the WorldMiles Partners. Loylty Rewardz and IndusInd Bank shall under no circumstances be responsible for any disputes relating to them.and shall not entertain any communication with respect to the same.
  5. Failure of a Member to quote the WorldMiles Membership account number and name as mentioned on the WorldMiles IndusInd Bank Credit Card when booking flights or making other travel bookings on www.myworldmiles.com may result in applicable WorldMiles not being credited to the Members WorldMiles Membership account and neither Loylty Rewardz nor its Program partners will have any responsibility for the failure in creditingto the WorldMiles Membership account.

PRODUCTS & SERVICES

The information on products and services provided on this site is for general description purposes only. Furthermore, not all the products or services are available in every state or country. Members are requested to contact Loylty Rewardz for details regarding terms and conditions, exclusions, products and services.

  1. Airlines: Members have a choice of full service and low-cost airline options. Low-cost airlines do not have all services available on board hence please choose the airlines carefully before booking. Members are advised to go through the fare rules and also select their class of travel. There are paper tickets and/or e-tickets that will be provided to the Member. Both are valid for travel by the airlines. However certain airlines do not entertain e-tickets. In such cases the Member will be issued paper tickets. Loylty Rewardz is only an intermediary party hence cannot be held responsible for any delay or cancellation of flight or change of route – a decision taken by the airline. Members will be subject to all terms and conditions as per the airlines.

Baggage

Members will have to limit themselves as per normal baggage policy of the airlines in the respective class that they have chosen to fly. Any excess baggage that a Member carries shall remain their responsibility. Any loss of baggage by the airlines or the Member will be the sole responsibility of the airline and the Member. Normally in economy class 20kgs is permitted however if the Member is traveling to US/ Canada they are permitted to carry 2 pieces as check in and 1 piece as cabin baggage. Members are requested to kindly refer to the baggage rules of the individual airlines as the same gets updated from time to time.

Health and Insurance

It is advisable that the Member acquires adequate insurance cover to secure their life health and property. Member can purchase the same from Loylty Rewardz site. Members health and good life is of utmost importance to Loylty Rewardz.

  1. Hotels: While booking a hotel on the site please carefully go through the information/fact sheet in detail to ensure that the amenities present are as per your requirement. Renovation at hotels is normally undertaken at sole discretion of hotels and not necessarily is informed to Loylty Rewardz.
  2. Holidays: Please refer to inclusions and exclusions carefully before booking. Members can customize their holidays completely on the site if the offered packages do not meet requirements.

PAYMENTS

All online payments that happen for any of the products booked via www.myworldmiles.com site are secure. This site does not store any credit card details in their database or in any data backup system or retrieval systems. Once a Member is ready to transact the Member is transferred to a bank site.

REFUND

Ezeego1 reserves the right to determine the amount of refund value in case of cancellation and amendments. The decision on the quantum of refund will be final as made by Ezeego1. The refund will be made in the name of the Member. There will be no refund for unutilised services unless specified. All cancellation and amendment charges will be as per the standard airline/ service provider pliicies.

EARNING MILES

  1. FlightMiles will be earned by the Member only on successful completion of the Journey. Member will not earn FlightMiles on cancelled or unutilized flight tickets.
  2. Member can earn PartnerMiles on www.myworldmiles.com on successful completion of the activity like hotel stay, car rental, movie ticket booking etc. Member will not earn PartnerMiles on cancelled activities.
  3. Member can earn SpendMiles on using the IndusInd Bank WorldMiles Credit Card for his daily purchases. SpendMiles will be transferred to the WorldMiles Membership Account on a monthly basis.
  4. The FlightMiles for a Qualifying Flight on www.myworldmiles.com shall be based as mentioned on the site. The number of FlightMiles for a Qualifying Flight will be based on the base fare booked and sector of travel. The maximum base FlightMiles will accrue on the full base fare level on every sector. Qualifying Flights flown on fares less than full base fares will accrue FlightMiles less than Base FlightMiles accrued on the highest base fare on a qualifying flight.
  5. To ensure credit of WorldMiles, the Member must make all of his/her bookings on www.myworldmiles.com by logging into his/her WorldMiles Membership Account. Bookings made outside the members login account stand ineligible for WorldMiles. This shall apply even in the case of a WorldMiles Group Membership Account.
  6. No FlightMiles will be accrued where a flight booked is cancelled or re-routed due to any reason beyond the reasonable contrli of Loylty Rewardz, including without limitation, like weather delays, natural calamity, etc.
  7. All activities that are not tracked automatically at the time of travel may be credited later at the discretion of Loylty Rewardz subject to the claim for Flight or PartnerMiles being made within 2 months from the date of travel or the relevant transaction.
  8. The Member is solely liable to check whether the WorldMiles have been correctly credited to the WorldMiles Membership account or not.
  9. Members are advised to retain their boarding passes till the WorldMiles accrued appear on their monthly statement. Members shall immediately and in any case within two months from the date of travel, report any omissions or errors in their WorldMiles Membership Account to the Loylty Rewardz Service Centre via email, fax or online at www.myworldmiles.com.
  10. Loylty Rewardz is not responsible for the delivery of any correspondences addressed to Loylty Rewardz customer service.
  11. 11.  Altered, mutilated or illegible documents will not be accepted for the purpose of crediting or debiting of WorldMiles.

VALIDITY

  1. WorldMiles are computed as total of FlightMiles, SpendMiles and PartnerMiles.
  2. FlightMiles and PartnerMiles are accrued basis members activity on  www.myworldmiles.com and are credited within 7 working days, after the completion of travel, to the Members WorldMiles Membership account.
  3. SpendMiles earned on the IndusInd Bank WorldMiles Credit Card are credited to the Members WorldMiles Membership account on a monthly basis. These SpendMiles shall be credited within 7 workings days of receiving the request from IndusInd Bank.
  4. These miles are valid for a period of 24 months from the date on which they accrue excluding the month of accrual. Eg WorldMiles accrued on 16th January, 2009 would be valid till 16th February, 2011.
  5. Loylty Rewardz may, from time to time, change the minimum number of WorldMiles needed to qualify for redemption or the Flight Miles applicable on any sector without giving any prior notice to the Member.
  6. Loylty Rewardz may, from time to time, change the PartnerMiles accrued through bookings made on www.myworldmiles.com, without any requirement of giving prior notice to the Member.
  7. WorldMiles are not transferable and cannot be combined with any other Members   WorldMiles Membership Account or any loyalty points or frequent flyer miles. WorldMiles in a Members account may be combined with another Members WorldMiles Membership Account if the two Members belong to the same family. The Member would need to call & inform Loyalty Rewardz that the WorldMiles from the other Members WorldMiles Membership Account are required to be clubbed into his WorldMiles Membership Account.
  8. At no time may WorldMiles be credited to, or WorldMiles be purchased by or slid to or transferred to any person. Any such transfers of WorldMiles would make   WorldMiles liable to be forfeited. Any person who commits or attempts to commit any of the foregoing acts is liable to indemnify for any actual or expected damages, litigation and related costs to WorldMiles and/or its Program partner (as the case may be). Loylty Rewardz, reserves the right to terminate Membership of such Member. It is hereby clarified that a Member may redeem WorldMiles for flight tickets (in accordance with the procedure specified in this regard) in the name of any person/s chosen by the Member.
  9. WorldMiles will be credited only to the Member who has booked the flight, on the relevant sector, and not to any third party, irrespective of who has paid for the seat. WorldMiles shall only be accrued if the payment is made through the IndusInd Bank WorldMiles Credit Card.
  10. For connecting flights for tickets booked through www.myworldmiles.com, WorldMiles will be credited as the total of the separate sectors of the trip. However, on direct or through flights with one or more intermediate stops, WorldMiles will be determined from the place of origin to destination of travel.
  11. WorldMiles will accrue for each sector flown on a Qualifying Flight only. The Member must travel on an eligible fare to qualify for WorldMiles.
  12. Vliuntary change in aircraft in lieu of non-stop and/or direct flights for accumulation of additional mileage or segments is not permitted.
  13. The following category of tickets/travel do not entail accrual of WorldMiles:
    1. Travel on gratis tickets.
    2. Refunded, forfeited and unused tickets, including non-refundable tickets.
    3. Free tickets of any kind, including tickets redeemed against WorldMiles issued under this program.
    4. Tickets purchased to carry excess baggage such as musical instruments or to provide extra space for the primary passenger.

REDEMPTION

  1. Members may redeem their WorldMiles for a flight ticket only after having recorded a minimum of 10,000 WorldMiles in their WorldMiles Membership Account and minimum of 3 WorldMiles transactions.
  2. WorldMiles flight tickets shall be issued in the sole discretion of Loylty Rewardz or the Program partner (as applicable).
  3. Member can redeem WorldMiles against base fare along with the taxes.
  4. Obtaining all relevant documentation (visa, travel, permits etc) as may be required for the intended travel is the responsibility of the Member. If not available, Loylty Rewardz shall not be liable for refusal of entry into any destination by relevant authorities or any other loss caused to the Member.
  5. Requests for redemption need to be placed a minimum of 2 days prior to the desired travel date
  6. In case of a WorldMiles Group Membership Account, any of the Members may call & request for redemption of WorldMiles.
  7. WorldMiles Flight tickets:
    1. WorldMiles flight tickets on the WorldMiles Program may be requested for both one-way and return tickets.
    2. WorldMiles flight tickets are valid for specific flight, date and Sector only and cannot be preponed or postponed under any circumstances.
    3. WorldMiles flight tickets may be issued to any individual as requested by the Member prior to issue of the WorldMiles flight ticket.
    4. WorldMiles flight tickets issued against WorldMiles are not eligible for earning WorldMiles.
    5. There are no blackout dates in relation to flight tickets. However, WorldMiles flight tickets are booked under a specific fare level. When the seats reserved, under the said fare level on any given flight, are full, applications for redemptions of flight tickets on the said flight cannot be processed.
    6. Loylty Rewardz reserves the right to limit the number of seats made available for WorldMiles flight tickets at its absliute discretion and without requirement of giving any prior notice to the Member.
    7. In addition to these terms and conditions, the Worldmiles Program and services of Program partners may also be subject to the terms and conditions of the Program partners in this regard Member shall be responsible to verify the additional conditions that may apply when availing services under the Worldmiles Program.
    8. Sale, purchase or barter of WorldMiles is not permitted and will be considered a breach of these terms and conditions, unless the transaction is carried out with Loylty Rewardzs consent and by its authorized personnel. WorldMiles flight tickets do not have any monetary refund value.
  8. Child Redemptions:
    1. WorldMiles flight tickets can be issued for infants (below 2 years of age) as well as for children (of age 2 years and above and less than 12 years).
    2. All redemption requests by Members for WorldMiles flight tickets for infants & children (of age 2 years and above and less than 12 years) must be accompanied by proof of age of the child. i.e. passport or birth certificate, as airline may need to verify these documents.
    3. All redemption requests by Members for WorldMiles flight tickets for infants children of age 2 years and above and less than 5 years   will be processed only if the infant/ child is accompanied by an individual 18 years and above responsible for the infant/ child and travelling on the same flight.

    Procedure for offline redemptions

    1. WorldMiles flight tickets for WorldMiles or services for its Program Partners can be redeemed offline by submitting a written request to the Loylty Rewardz service centre in the prescribed form filled in and duly signed by the Member.
    2. For offline redemption, the Member must provide at least 3 working days for Loylty Rewardz service centre to process the request.
    3. The applicable taxes and governmental charges are payable at the airport reservations desk.
    4. A request for WorldMiles flight tickets will not be considered valid unless completed in all respects and duly submitted by the Member. In case of a written request for redemption, unsigned requests will not be processed. Loylty Rewardz reserves the right to verify the signature on the request form submitted by the Member with the signature on the enrliment form or proof of identity provided by the Member. In case of a WorldMiles Group Membership Account, any of the Members may request for the redemption.
    5. WorldMiles flight tickets will be booked and issued directly by Loylty Rewardz. No other person, including without limitation, travel agencies are authorized to book or issue or change WorldMiles flight tickets.
    6. No open dated WorldMiles flight tickets shall be issued under the WorldMiles Program.
    7. The Member will be responsible for all other expenses and any other charges, claims or liabilities arising in relation to the use of WorldMiles flight tickets.
    8. 25% WorldMiles will be redeemed in the case of infants (below 2 years of age) travelling with a Member on a WorldMiles flight ticket.
    9. 75% WorldMiles will be redeemed in the case of children (of age 2 years and above and less than 12 years) traveling with a Member on a WorldMiles flight ticket.
    10. Redemption requests may be made through WorldMiles website no later than 2 working days before departure of relevant flight.

    There would be no charges for stopovers included in a WorldMiles flight ticket itinerary, where stopovers are at connecting points on the most direct route between the origin and destination.

    CHANGES & CANCELLATION OF WORLDMILES FLIGHT TICKETS

    WorldMiles Flight tickets issued by Loylty Rewarz are valid only for the date printed on the face of the ticket and cannot be changed or extended under any circumstances.

    Changes to WorldMiles flight tickets are not allowed.

    Cancellation of WorldMiles flight tickets is not permitted. In the event of a cancellation, redeemed WorldMiles will not be credited back into the Membership account and shall be deemed as utilized.

    WorldMiles for WorldMiles flight tickets that have not been cancelled and are not utilized will not be re-credited to the Members account and shall be deemed as utilized.

    In the event of a no-show on WorldMiles flight tickets (Members who do not present themselves in time for their booked flight) the redeemed WorldMiles will not be credited back into the Membership account and shall be deemed as utilized.

    PROFILING – UPDATING MEMBER DATA

    1. By using the IndusInd Bank WorldMiles Credit Card or quoting the WorldMiles Membership Account number on www.myworldmiles.com or contacting the Loylty Rewardz call centre or call centers of any of the WorldMiles Program partners, a Member consents Loylty Rewardz for creating, maintaining and updating Data. The Data will be maintained and updated for the purpose of providing relevant information and services to the Member.
    2. For reasons of security and identity verification, a Member may be asked certain questions before revelation of Data pertaining to the Member that is held by IndusInd Bank.
    3. Only the Member would be eligible to obtain Data from IndusInd Bank relating to his/her own Membership. Notwithstanding the foregoing, any and all Data or information in a Members WorldMiles Membership account may be disclosed by Loylty Rewardz, as may be required by law, including without limitation, disclosure to the pliice, immigration and customs authorities.
    4. The Member is responsible for the security of his/her online logins and passwords and Loylty Rewardz shall have no liability whatsoever in the event of a misuse or fraudulent use of a Member login or password.
    5. Loylty Rewardz reserves the right to block online access to Data by or through any third party website not authorized by Loylty Rewardz.
    6. In an effort to provide valuable information and offers to Members, Loylty Rewardz develops mailing lists for use by themselves and their Program Partners. These lists are developed under strict conditions designed to safeguard the privacy of the Members information. As part of providing value added services to the WorldMiles Members, Loylty Rewardz reserves the right to send special offers/products to the Members.
    7. Consent to receive such offers will be deemed as given until such time that the Member expressly withdraws his/her consent to receive mailers and offers from Loylty Rewardz and its various Program partners by opting out of the relevant preference either by notifying the   Loylty Rewardz call centre in writing or on the site. Loylty Rewardz will remove, or in the case of a WorldMiles Program partner, make efforts to procure the removal of, the name of such Member from the mailing list within 30 working days. Withdrawal of consent may result in certain services not being offered and/or provided to the Member.

    COMMUNICATION / CORRESPONDENCE

    Members will be emailed a monthly statement reporting all the activities recorded in their WorldMiles Membership account since the statement for the previous month. The summary statement indicates the WorldMiles earned. The statement will combine FlightMiles, SpendMiles and PartnerMiles earned on a monthly basis.

    In case of a dispute regarding computation   of WorldMiles, Loylty Rewardz may require proof of travel including the retained segment of the boarding pass, WorldMiles e-ticket and passenger receipts for the sector claimed to have been flown. Claims must be lodged in writing or on WorldMiles website no later than 2 months from the date of travel.

    WorldMiles Membership Account statements are also available online at the WorldMiles website. A  Member can access the statement details by logging into his/her WorldMiles Membership Account on WorldMiles website with his/her WorldMiles login and password.

    AUDIT & DISQUALIFICATION

    Loylty Rewardz reserves the right to audit the Members WorldMiles Membership account at any time, without notice to the Member, to ensure compliance with the terms and conditions of the WorldMiles program, conditions of carriage (which apply to all guests) and applicable governmental regulations.

    Conditions of carriage include a prohibition against actions involving fictitious multiple bookings. In the event that the audit reveals discrepancies or isliations or fraud, the processing or WorldMiles flight tickets and mileage summaries may be delayed or suspended until such discrepancies, violations or fraud is resolved.

     The WorldMiles Membership account of any Member breaching or viliating the terms and conditions may be withheld (e.g. WorldMiles may not be redeemed from a withheld WorldMiles Membership account).

    Loylty Rewardz may impose charges on such Members by deducting WorldMiles from their WorldMiles Membership accounts.

    Loylty Rewardz also reserves the right to disqualify any Member from further participation in the WorldMiles Program if in Loylty Rewardzs sole judgment; such Member has breached the terms and conditions or viliated the conditions of carriage or any of the rules described herein.

    Data in physical form will be retained by Loylty Rewardz up to a maximum of 3 months after which Loylty Rewardz may, at its option, preserve an electronic copy of the same.

    TERMINATION OF MEMBERSHIP

    If a Member wishes, he/she may terminate the Membership by providing notice in writing and by surrendering the IndusInd Bank WorldMiles Credit Card to IndusInd Bank Customer Service. However, such termination of Membership by a Member shall not relieve him/her from any obligations, which are intended to survive, or by its nature survives the termination of WorldMiles Membership Account. The Member will not be then bound by any continuing obligations under these Terms and Conditions.

    Cancellation of the IndusInd Bank WorldMiles Credit Card will automatically result in cancellation of the Membership. Loylty Rewardz and the Program partners may at any time in its discretion terminate or suspend the Membership of any Member and /or the right of any Member to use the WorldMiles Program privileges. In case of such termination by Loylty Rewardz or the Program partners, WorldMiles in the WorldMiles Membership account of such Member shall stand forfeited. In the case of suspended Membership, Loylty Rewardz may in its discretion, debit WorldMiles and/or request undertakings in respect of future conduct to revive the Membership.

    On the death of a Member, the WorldMiles Membership account will be closed. However, the Members legal heir, on production of relevant documents can redeem the WorldMiles available in the deceaseds WorldMiles Membership account, subject to the validity of the WorldMiles and the Membership itself.

    CHANGE OR TERMINATION OF PROGRAM

    1. Loylty Rewardz may in its discretion at any time, without giving notice, change or modify or terminate the redemption structure by revising the WorldMiles Program required to attain a particular WorldMiles flight ticket, stipulate a specified period during which WorldMiles cannot be redeemed, limit the number of seats available for the redemption of WorldMiles to any or all destinations or on certain specified flights: alter the number or types of journeys required to obtain a particular WorldMiles flight ticket; change, modify or withdraw the WorldMiles chart, Program partners affiliations, change the parties from which a WorldMiles flight ticket may be obtained/redeemed, change the length of time after being rewarded within which WorldMiles must be redeemed; impose a time limit upon validity for redemption of any WorldMiles issued by Loylty Rewardz ; introduce and/or review Membership fees; any special offers, and modify and change the procedures and rules relating to ticketing on redemption of WorldMiles, as well as any benefits provided in connection with the WorldMiles Program and any special offers or promotional offers made to any tier or group of Members or any other aspect of the WorldMiles Program.
    2. Loylty Rewardz may in its discretion at any time, without giving notice, change the WorldMiles Program rules, regulations, WorldMiles flight ticket and special offers at any time without notice. This means that Loylty Rewardz may initiate changes, for instance, impacting partner affiliations, rules for earning and credit of WorldMiles, rules for redemption of WorldMiles flight ticket against WorldMiles, continued availability of rewards, blackout dates or limit the seats available for flight tickets travel to any or all destinations including but not limited to allocations on flight tickets seats on certain flights.
    3. Loylty Rewardz may terminate the WorldMiles Program (in its entirety or part) at any time but will use its reasonable endeavours to give at least one months notice to Members. At the end of the notice period, the Members right to use the services or receive any benefits under or pursuant to the WorldMiles Program, including without limitation, the earning and redemption of WorldMiles will cease. The Members legal heir, on production of relevant documents can redeem the WorldMiles available in the deceaseds WorldMiles Membership account, subject to the validity of the Miles and the Membership itself.

    LIMITATION OF LIABILITY

    1. Loylty Rewardz and/or Program partners shall not be liable to any Member or to such Members nominee or companion or guardian, for any direct, indirect or consequential loss, damage or expense of any kind whatsoever, arising out of or in connection with the WorldMiles Program and/or the provision or the refusal to provide any benefits or service, whether such loss, damage or expense is caused by negligence or otherwise, and whether WorldMiles and or its Program partners have any contrli over the circumstances giving rise to the claim or not.
    2. The terms and conditions shall be governed by and construed in accordance with Indian law. Loylty Rewardz and the Member irrevocably submit to the exclusive jurisdiction of the courts and tribunals of Mumbai to reslive any disputes that may arise out of or in connection with WorldMiles Program
